The enabling environment plays a major role in the success of an ACA, and the CIAA Nepal case illustrates this. The following excerpt is taken from the report’s introduction, which describes the situation in Nepal.

The Prevention of Corruption Act of 1961 (PCA) was amended in 1975 to provide for the Commission for the Prevention of  Abuse of Authority (CPAA), which became operational in 1978 and under which a Prime Minister, four cabinet ministers and several top government officers were prosecuted and convicted in one carpet invoice case. The CPAA was not just an investing agency, but also a quasi-judicial tribunal empowered to adjudicate and sentence alleged culprits. The Commission was criticized for its power to investigate and adjudicate cases as undemocratic and contrary to principles of justice.
